For your first post your not getting off on the right foot. First off CS4 just came out at the end of Sept. Not everyone jumps on new products as soon as they are release since there are usually kinks that have to be worked out because Adobe rushes release dates.
Dont know if you have noticed but there is a global financial decline, so im sure not everyone is jumping at CS4 at the moment.

If an author submits a file for sale that includes BOTH CS3 and CS4 flash files I would appreciate the CS4 file. What’s the point of a stock flash site if they’re going to wait a year before they adopt CS4 . As a developer I want CS4 items NOW . Honestly.Think of this, if you make a project in CS3 (AS3) it will support CS4 (AS3) easily with no problem.
The moment your main project is in CS4 and if you are using any of the new tools in CS4 (which you will) your file will be good only for CS4 .
I am Adobe certified CS3 /AS3 and I promise you, the way things are going CS4 will the slowest migration ever in the history of flash version, it’s simple to fast Adobe rushes release CS3 then AS3 then CS4 and all this in 3 years.
And if you look at this in a global matter AS2 is still the most popular version that flasher`s work today ,i shift all my work to AS3 but I cant imagine that million of flashers will rush and do the same .

I think the assumption would be that if you forked over the money to buy / upgrade to cs4 then you know how to code and don’t need to buy flash packs. I would be more disturbed about all of the AS2 files really…
That would be a pretty bad assumption.
You could buy 10 templates on this site and have a higher tab than the upgrade price of Flash CS4 .
I would actually argue that if you were really wow’d by CS4 ’s features there’s a good chance you aren’t an AS guru considering many of the hot new features were already available for people who weren’t doing timeline based animations. 3d, advanced tweening with complex eases, and even ik simulation could all be done in code previously.

I was kind of disappointed as a buyer to hear the news. I am excited to use the new technology and better workflow inside of CS4 especially in flash. And Geoken is right. I am not a AS guru and love all the new timeline animation and 3d stuff. Plus the work flow and workspace is super better in my opinion. I may be wrong but I thought the flash player 10 was faster or something. I look forward to the day we can buy CS4 files 
I dont know if it is possible but it would be nice to have both versions of fla file included when possible.
Once the authors find possiblility of salable stuffs on CS4 , they will just start to do it. There is nothing to blame about FD or Authors. If there are any special requirements you have and possible only through CS4 , then inform here and people will start move on that way.
